Battle For Bagga: Delhi Police Take On Punjab Cops As Charges Fly Thick And Fast

Delhi Police becomes answerable on the complaint made by the AG of Punjab that Bagga is handed back to Punjab as soon as possible since there is a criminal case pending against him.

Chandigarh: Yesterday, Delhi Police registered a case of kidnapping Tejinder Pal Singh Bagga, who had been picked up by the Punjab Police after a case was registered against him by its cyber cell.

Now Punjab Advocate General (AG) Anmol Rattan Sidhu has submitted in the Punjab and Haryana High Court that “Delhi Police officials have illegally taken away Bagga from the lawful custody of the Punjab Police.”

And that now Delhi Police becomes answerable on the complaint made by the AG of Punjab that Bagga is handed back to Punjab as soon as possible since there is a criminal case pending against him.

“Look at it, the accused is being snatched and Delhi Police is escorting him and he is waving at the crowd as if he is the King,” said AG Anmol Rattan Singh Sidhu.

Asked, if Punjab Police committed a faux pas and just picked up Bagga without following the due procedure, Sidhu said, “We followed the procedure and we have a video of it.” He said that Bagga was legally arrested and that Haryana Police’s action was unwarranted and unprecedented.

Delhi Police’s Reply And The Botch-up By Punjab

Delhi Police has said, that they had search warrants issued by the Dwarka court magistrate. Raman Walia, advocate at the Punjab and Haryana High Court contended, “It was the Punjab Police which skipped something very important which was registering a DDR at Janakpuri Police station.

That was a big botch up they committed in the anxiety of arresting him as early as possible.” Walia added, “Now Bagga can apply for the anticipatory bail. Already, he has petitioned for the quashing of the FIR in the court.”

SK Garg, advocate Punjab and Haryana High Court too said, “Punjab Police completely messed up this case. They should have gone to the local police station at Janakpuri and informed them before arresting Bagga. Irrespective of whether the Delhi Police was indulging in dilly-dallying, they couldn’t have arrested him without their prior knowledge and without following the due procedure.”

He though avers that what happened subsequently was an open display of politics between the Aam Aadmi Party (AAP) and Bharatiya Janata Party (BJP) and unhealthy for a functioning democracy. Legal experts said it will open floodgates of such cases in future.

Punjab And Haryana HC Adjourns The Matter Till Tuesday

The matter pertaining to the petition filed in Punjab and Haryana High Court regarding the alleged “illegal taking away of Tajinder Pal Singh Bagga from the lawful custody of Punjab Police” was to come up for hearing today. But now the matter will be heard on Tuesday.

FIR In Punjab, And Delhi Provides Security To Bagga

After Bagga was released from Punjab police’s custody, he was brought to Delhi and presented before a court in Dwarka. The Duty Magistrate directed the Delhi Police to provide security to Bagga and also his family.

The security was provided after Bagga expressed that he was apprehensive that such incidents may happen again, his lawyer argued. Any future attempts to arrest may result in more complications as one set of policemen will be up against another set of policemen with a whole lot of procedures to follow.
