Delhi Riots Case: Court To Hear Umar Khalid’s Bail Plea

Umar Khalid claims that he was arrested for “conspiracy” over the riots that took place in the Capital in February last year.

New Delhi: Delhi Court will continue to hear Umar Khalid’s bail plea in connection with the Delhi Riots Larger Conspiracy case involving charges under IPC and UAPA, On Tuesday.

The case will be heard before Additional Sessions Judge Amitabh Rawat. The Court had previously heard the plea on Saturday, and had adjourned the matter till Tuesday.

The case accused Umar Khalid claims that he was arrested for “conspiracy” over the riots that took place in the Capital in February last year.

On September 6, Umar Khalid’s counsel had moved a fresh bail plea under Section 437 under the Code Of Criminal Procedure (CrPC) after withdrawing the previous bail plea filed under Section 439 of CrPC.

Khalid’s counsel had withdrawn the plea when Special Public Prosecutor Amit Prasad, appearing for Delhi Police, raised objection on the maintainability of the plea filed under Section 439 CrPC in the last hearing.

Earlier other accused Ishrat Jahan and Khalid Saifi also withdrew their bail pleas under Section 439 of CrPC and later filed them under Section 437 the CrPC.

The Delhi Police on Sept 8 had filed a reply in a city court opposing the fresh bail application of Umar Khalid. ASJ Amitabh Rawat adjourned the matter for further hearing.
