Madras HC upholds 27% OBC Quota In Medical Entrance, Puts A Rider On EWS Seats

The state govt had approached the HC seeking this reservation policy be applicable to medical colleges in TN for admission under All India Quota AIQ for common medical entrance test NEET.

New Delhi: Provision of 27% reservation in Medical seats for OBC students under the All India Quota (AIQ) may be permissible, but extending 10% reservation to AIQ seats for Economically Weaker Sections (EWS) is not permissible without approval from the Supreme Court of India, the Madras High Court said on Wednesday (August 25).

A bench of Chief Justices Sanjib Banerjee and PD Audikesavalu pronounced judgment in the contempt plea filed by the ruling Dravida Munnetra Kazhagam (DMK) over OBC reservation in all India medical seats.

The inclusion of 10% vertical reservation for EWS would require approval of the Supreme Court.

On August 18, the DMK had petitioned Madras High Court saying that the 27% of the seats offered by the Centre for admission of students in Tamil Nadu is unacceptable.

The propriety of implementing EWS reservation without any court order was questioned in the petition. The High Court had reserved order for Wednesday.

On July 29, the central government had approved 27% reservation to candidates belonging to OBCs and 10% reservation for EWS aspirants in the AIQ scheme for undergraduate and postgraduate medical and dental courses.
