SC To Hear Plea Seeking Action Against Haridwar’s Dharam Sansad ‘Hate Speech’

New Delhi: The Supreme Court on Monday agreed to hear PIL seeking criminal action against the alleged hate speech delivered during ‘Dharma Sansad’ held in Haridwar.

The petition was filed by former Judge of Patna High Court and Senior Advocate of the Supreme Court, Anjana Prakash and journalist, Qurban Ali.

Advocate Kapil Sibal who approached the Supreme Court submitted an FIR and added that no arrests have been made so far. Sibal urged the apex court to take up the matter on an urgent basis, stating that,’ we are living in the times of ‘Shashtramev Jayate‘ instead of ‘Satyamev Jayate‘. The term Satyamev Jayate roughly translates to ‘truth shall prevail’.

Sibal had urged the apex court and said that no action will be taken in Uttrakhand if they did not intervene in the matter. On January 2,  a five-member Special Investigation Team (SIT) was constituted to probe the case of alleged hate speech delivered in Haridwar between December 17-19.

In Uttrakhand, Haridwar Police informed on January 1, that they have added the names of Hindu leaders Yeti Narasimhanand and Sagar Sindhuraj in an FIR in connection with the case of alleged hate speech.

Earlier, the police had informed that Dharm Das, Annapurna, Wasim Rizvi aka Jitendra Tyagi, and some others have been booked under Section 153A of the Indian Penal Code in the case.

Police have also added Section 295 (destruction, damage, or defilement of a place of worship or an object held sacred, with intent to insult the religion of a class of persons) of the Indian Penal Code to the FIR. The Dharma Sansad in Haridwar was held on December 17-19.

On December 31, 2021, a separate petition was filed in the Supreme Court by Jamiat Ulama-i-Hind and Maulana Syed Mahmood Asad Madani urging appropriate directions in relation to ‘hate speech’ and continuous attacks on the Muslim community at large.

Two separate instances of hate speech in Uttarakhand and Chhattisgarh have stirred another political row in the poll-bound state.

On January 5, All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi slammed both Bharatiya Janata Party and Congress over the issue of alleged hate speeches delivered in ‘dharma sansad‘ (religious council) in the states ruled by the two parties. “Dharma sansad held Uttarakhand discussed eliminating Muslims. Similarly, dharma sansad held in Raipur also talked about eliminating Muslims. In Uttarakhand, BJP is in power and Congress in Chhattisgarh, but no action is being taken by the two governments against anyone,” said Owaisi.
